Petition against sacked CJP’s detention dismissed.

LAHORE: Lahore High Court (LHC) Chief Justice Syed Zahid Hussain on Thursday dismissed a petition by Advocate Tariq Aziz Malik, challenging the alleged detention of sacked chief justice Iftikhar Muhammad Chaudhry and his family.

The LHC office had raised an objection that the petition should be filed before the High Court established for capital territory. However, it was fixed before the LHC chief justice as an objection case.

The petitioner submitted that the principal seat of the LHC had the authority to hear this matter, but the chief justice did not agree with him and sustained the objection.

Malik had moved the petition under Article 199 of the constitution, making the federal government, three federal secretaries interior, the establishment and the law respondents.

He said the chief justice had been detained for the last four months without any legal justification and his children were not allowed to go to school.

He said detaining the chief justice amounted to an insult of the judiciary. He asked the court to issue directions for the release of Justice Iftikhar Muhammad Chaudhry and his family.
