Aitzaz says parliament cannot be sovereign without restoration of judiciary After expiry of 30 days, SCPBA to adopt future line of action

OKARA: The lawyers will not accept the restoration of judiciary without reinstatement of chief justice of Pakistan Iftikhar Muhammad Chaudhry.
Barrister Aitzaz Ahsan, president Supreme Court of Pakistan Bar Association, said this while addressing the District Bar Monday.
He said the solidarity of the country was possible with an independent judiciary not with weapon. Whoever judge reinstated without Iftikhar Chaudhry would be deemed a judge under PCO, he added.
The present parliament could not be sovereign without restoration of judiciary, he maintained. Aitzaz said former prime minister Shaukat Aziz had fled the country after selling the Pakistan Steel Mills for Rs 2.2 trillion only, whereas its actual price amounted to more than 15 trillions.
He said President Musharraf and Q-League had gained the status of 'Ali Baba and Forty Thieves' because the Q-League could have won 40 seats in the elections. Aitzaz said the nuclear weapons could not safeguard the national solidarity if the common citizens led their life in poverty. The USSR had stored 40,000 nuclear weapons even then it had been disintegrated.
He disclosed that the government had offered to the bar to restore 44 judges without Iftikhar Muhammad Chaudhry, but the bar rejected this offer. He said the army rule could never have a constitutional reason.
He said the bar wanted to get all the deposed judges, including CJP Iftikhar Muhammad Chaudhry reinstated.
He said on Feb 18, the people of the country had rejected President Musharraf but he was not ready to quit his office. The black coats had forced Musharraf to shed his uniform and hold general elections, he maintained.
Musharraf had been planning to rig the election the whole year, But, on the election day, his effort was foiled by Army Chief Gen Kayani. Despite rigging, the Q-League of Musharraf won only 40 seats, he remarked.
Aitzaz said since 1954 to March 9, 2007, the country's judiciary had been in a submissive position. But Iftikhar Chaudhry had changed the judicial history of the country, he pointed out.
He had detained Iftikhar Muhammad Chaudhry and his children and water supply was also suspended, Aitzaz said.
The Aitzaz said although Rana Bhagwan Das had got retirement, yet the bar would restore his dignity and honour. He said no courts could be restored unless the rule of Musharraf was ended.
He announced that after the expiry of 30 days the bar would adopt a future line of action. He said the parliament and the political parties could enjoy a safe future if they restored Iftikhar Muhammad Chaudhry and the other deposed judges.
The bar was also addressed by president bar Chaudhry Saghir Agmad Harni and secretary general Sajjad Hassan Naroo.
The PPP, PML-N and Jamaat-e-Islami local leadership and citizens also attended it.

OKARA: Supreme Court Bar Association President Chaudhry Aitezaz Ahsan said national security can be ensured by independent judiciary not weapons. Addressing Okara Bar here, he said the judge, who would sit on the seat without Justice Iftikhar Mohammed Chaudhry as the Chief Justice of Pakistan, would be a PCO judge. Aitezaz Ahsan said the parliament cannot enjoy credibility without the restoration of judiciary, adding the government offered him the restoration of all 44 judges sans Justice Iftikhar Mohammed Chaudhry; however, he is indisposed to any such proposal. ‘There is no justification for the military to come into powers,’ he maintained. Aitezaz Ahsan warned the next stage of the lawyers’ movement would be announced, in case judges were not restored in 30 days. SCBA president demanded PPP leadership to make Pervez Musharraf apologize on disrespecting Zulfiqar Ali Bhutto and Benazir Bhutto, adding he will then make Iftikhar Mohammed Chaudhry to seek apology from the nation over taking oath under PCO.
