A three member bench of the apex headed by Chief Justice Iftikhar Muhammad Chaudhry resumed the hearing of the case during which Additional Advocate General Khyber Pakthnkhwa told the bench that IG KPK has suspended concerned SSP Operations, SHO and other police officials. He further said that the provincial government has launched an enquiry, report of which would be presented in two weeks.
Finding serious illegalities in the murder case of daughter-in-law of incumbent Inspector General Islamabad, the apex court had issued notices to police chiefs of the capital and Khyber Pakhtunkhwa as well as other senior officers. �Serious damages have already been done in the case as no FIR has been registered by the KPK police, and though the alleged incident took place in Peshawar the Islamabad police registered FIR in Shalimar Police Station but later cancelled it,� observed the bench.
The bench had suggested the police to engage lawyers for pleading their cases in the court. Appearing on court direction Senior Superintendent of Police (Operations) Islamabad Yasin Farooq informed the court that they registered a murder case with Shalimar police station on the orders of IG Bani Amin on May 19, 2013 but cancelled the case after six days on May 25. During the hearing on July 3 the SSP (Operation) had told the bench that IG Bani Amin and SHO Sajjad Haider are responsible for registration of FIR.
But during Thursday�s hearing, he submitted a list of people responsible for registering the FIR unlawfully without having territorial jurisdiction, which contained the names of IGP Bani Amin, SP Sadar Jamil Hashmi, DSP Margalla Rasheed Niazi, SHO Shalimar Sajjad Haider and the investigation officer (IO) sub-inspector Muhammad Rasheed. The chief justice inquired as to why he had not mentioned his name as well. The court ordered him to include his own name in the list as well. On the other hand IG KPK Ahsan Ghani admitted before the bench that the incident took place at University Town in Peshawar and could not justify the act of his police for not registering a criminal case.
