SC expresses displeasure over failure to present missing persons.



LAHORE: Chief Justice Iftikhar Muhammad Chaudhry Tuesday directed the Defence Secretary to appear before the Supreme Court in case he failed to produce 35 missing persons on November 28.
A three-member bench headed by Chief Justice Chaudhry heard the missing persons’ case at the Lahore Registry on Tuesday.
During proceedings, Chief Justice Chaudhry expressed displeasure over the failure to present the 35 missing persons and the absence of the Defence Secretary.
The Additional Defence Secrertary informed the apex court that the Defence Secretary was ill and thus could not appear. Chief Justice Chaudhry replied that if the Defence Secertary was ill he should take leave and give charge to someone else. “The missing persons are in your custody,” the Chief Justice said to the Additional Defence Secretary.
When the Additional Defence Secretary sought more time to present the missing persons, the Chief Justice replied that this was an excuse.
When proceedings resumed after a break, Chief Justice Chaudhry remarked that it was a violation of the law to detain someone illegally.
The government’s lawyer, Tariq Khokhar informed the court that the prime minister was in charge of the defence ministry and he could not be contacted. Justice Jawwad S Khawaja inquired whether the prime minister also held the portfolio of law minister in addition to that of defence minister.
Chief Justice Chaudhry remarked that this was an issue of not one but 35 missing persons and they would get to the bottom of the case even if the head of the government had to be called.
The hearing of the case will resume on a daily basis from Wednesday at the Supreme Court’s Karachi registry.
